浙江省人民政府辦公廳關于深化種業體制機制改革的若干意見

各(ge)市(shi)、縣(市(shi)、區(qu))人民政府(fu),省政府(fu)直(zhi)屬各(ge)單位(wei):
為增強種業創新能力和發展活力,加快發展現代種業,促進農業發展方式轉變,根據《中華人民共和國種子法》有關規(gui)定(ding)和《國務(wu)院辦公廳關于深化種(zhong)業(ye)體制(zhi)改革(ge)提高創新能力的意(yi)見》(國辦發〔2013〕109號)有關精神,經省政府同意(yi),現就深化種(zhong)業(ye)體制(zhi)機制(zhi)改革(ge)提出以下意(yi)見:
一、深化種業科研體制改革
深入實施創新驅動發展戰略,支持公益性科研院所和高等院校開展種業基礎性、公益性、前沿性研究,加大對其開展育種理論、共性技術、種質資源挖掘、功能性基因克隆、育種材料創新等研究的支持力度,增強種業基礎性研究能力。完善育種協作攻關組織模式,根據生產需求和發展趨勢,統籌育種資源和力量開展協作攻關,著力選育一批具有自主知識產權的突破性優良品種。完善育種科技項(xiang)目管理辦法,改進成果(guo)評價體系,品種(zhong)(zhong)選(xuan)育(yu)課(ke)題(ti)立項(xiang)和結題(ti)時(shi)要突(tu)出育(yu)成品種(zhong)(zhong)的(de)推廣(guang)應用規模指標。完善品種(zhong)(zhong)審定(ding)制度,鼓勵開展特異性(xing)、功能性(xing)品種(zhong)(zhong)選(xuan)育(yu),避免(mian)低(di)水平、重復(fu)性(xing)育(yu)種(zhong)(zhong)。
二、加快建立商業化育種資源向企業流動的機制
公益性(xing)(xing)科(ke)研(yan)(yan)院(yuan)(yuan)所(suo)和高(gao)等(deng)院(yuan)(yuan)校(xiao)所(suo)辦的(de)種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)要按照“產權(quan)(quan)清晰、股權(quan)(quan)多元、權(quan)(quan)責明確、管理科(ke)學”的(de)要求,完善企(qi)(qi)(qi)業(ye)(ye)法人治理結構,并(bing)按規定實(shi)現事企(qi)(qi)(qi)脫(tuo)鉤。對完成企(qi)(qi)(qi)業(ye)(ye)化改革(ge)的(de)科(ke)研(yan)(yan)院(yuan)(yuan)所(suo)或企(qi)(qi)(qi)業(ye)(ye)自(zi)建研(yan)(yan)發(fa)機構,優先(xian)進行高(gao)新(xin)技術(shu)企(qi)(qi)(qi)業(ye)(ye)認定;改革(ge)后,育(yu)(yu)種(zhong)(zhong)(zhong)(zhong)(zhong)科(ke)研(yan)(yan)人員在科(ke)研(yan)(yan)院(yuan)(yuan)所(suo)、高(gao)等(deng)院(yuan)(yuan)校(xiao)工(gong)作期間符合國(guo)家規定計算的(de)連續工(gong)齡,按規定視同(tong)基(ji)本(ben)養老保險(xian)繳費年限。鼓(gu)勵種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)與科(ke)研(yan)(yan)院(yuan)(yuan)所(suo)和高(gao)等(deng)院(yuan)(yuan)校(xiao)構建技術(shu)研(yan)(yan)發(fa)平臺,建立以市場為導向、資本(ben)為紐帶、利益共(gong)享(xiang)、風險(xian)共(gong)擔的(de)產學研(yan)(yan)相結合的(de)種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)技術(shu)創(chuang)新(xin)體系。加(jia)(jia)快(kuai)推進育(yu)(yu)種(zhong)(zhong)(zhong)(zhong)(zhong)材料(liao)、技術(shu)等(deng)育(yu)(yu)種(zhong)(zhong)(zhong)(zhong)(zhong)資源向種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)流動(dong),提升種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)技術(shu)創(chuang)新(xin)能(neng)力,加(jia)(jia)快(kuai)構建種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)基(ji)礎性(xing)(xing)研(yan)(yan)究(jiu)與商(shang)業(ye)(ye)化育(yu)(yu)種(zhong)(zhong)(zhong)(zhong)(zhong)分(fen)工(gong)協作的(de)新(xin)型(xing)種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)科(ke)技體系。
三、做大做強育繁推一體化的現代種業企業
鼓勵骨干種業企業按照“資源整合、優勢互補、做強做優”的原則開展不同形式的兼并重組,省農業發展投資基金加大對符合條件種業企業的資本注入,吸引社會資本參與,優化其資本結構,積極推進種業企業混合所有制改革。深入推進國有科研院所、國有種業企業、民營種業企業合作,積極探索政府與社會資本合作(PPP)模式,發揮多方優勢,實現融合發展。支持有條件的企業建立育種研發機構或團隊,引進高層次專業人才和育種創新材料,提升育種創新基礎設施裝備水平,積極開展商業化育種研發,建設高標準種子生產基地,構建“互聯網+”種業電子商務營銷平臺,獎勵(li)企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)自主(zhu)育(yu)(yu)成的(de)突(tu)破(po)性或具有重(zhong)大(da)應(ying)用(yong)價(jia)值農(nong)作(zuo)物新品(pin)種(zhong)(zhong)的(de)選(xuan)育(yu)(yu)推(tui)廣(guang),引導企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)向(xiang)育(yu)(yu)繁推(tui)一體(ti)化(hua)發展。稅務部(bu)門要按照國(guo)家有關規(gui)(gui)定減(jian)免(mian)育(yu)(yu)繁推(tui)一體(ti)化(hua)種(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)和種(zhong)(zhong)子行(xing)業(ye)(ye)(ye)(ye)(ye)信用(yong)等級A級以上企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)兼并重(zhong)組涉及的(de)增值稅,企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)從事農(nong)作(zuo)物新品(pin)種(zhong)(zhong)選(xuan)育(yu)(yu)的(de)所得(de)免(mian)征企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)所得(de)稅,企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)育(yu)(yu)種(zhong)(zhong)研(yan)發費(fei)用(yong)按規(gui)(gui)定享受企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)所得(de)稅加(jia)計扣除(chu)優惠政(zheng)策。省農(nong)信聯社、省農(nong)發行(xing)要加(jia)大(da)信貸(dai)支(zhi)持力度(du),對符合條件的(de)育(yu)(yu)繁推(tui)一體(ti)化(hua)種(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)給(gei)予一定的(de)政(zheng)策性貸(dai)款授信額(e)度(du)。省財政(zheng)重(zhong)點支(zhi)持培(pei)育(yu)(yu)省級以上農(nong)作(zuo)物育(yu)(yu)繁推(tui)一體(ti)化(hua)種(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)(ye)(ye)。
四、建立健全科研人才雙向流動機制
破除人才流(liu)(liu)動的(de)(de)體制(zhi)機制(zhi)障礙,推進育種(zhong)(zhong)(zhong)(zhong)創(chuang)新(xin)成(cheng)(cheng)果(guo)與(yu)種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)對接、研(yan)發人員(yuan)(yuan)創(chuang)新(xin)勞動與(yu)其利益對接,鼓(gu)勵事(shi)(shi)業(ye)(ye)(ye)(ye)(ye)單(dan)位種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)骨(gu)干(gan)科(ke)技(ji)(ji)人員(yuan)(yuan)通過兼職(zhi)(zhi)、掛職(zhi)(zhi)、簽訂合同等(deng)方式(shi)到種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye)開展技(ji)(ji)術(shu)服務,鼓(gu)勵高校(xiao)青年教(jiao)師到種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye)從(cong)事(shi)(shi)博士后(hou)研(yan)究(jiu)工作。科(ke)研(yan)院(yuan)所(suo)和(he)高等(deng)院(yuan)校(xiao)種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)科(ke)技(ji)(ji)人員(yuan)(yuan),經所(suo)在(zai)(zai)單(dan)位同意,可以在(zai)(zai)完成(cheng)(cheng)本職(zhi)(zhi)工作的(de)(de)前提下(xia),到種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye)兼職(zhi)(zhi)并領(ling)取報酬(chou),也可以帶著(zhu)項(xiang)目(mu)、成(cheng)(cheng)果(guo)到種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye)開展創(chuang)新(xin)工作或創(chuang)辦企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye),其人事(shi)(shi)關系(xi)5年內保留在(zai)(zai)原單(dan)位,其在(zai)(zai)種(zhong)(zhong)(zhong)(zhong)業(ye)(ye)(ye)(ye)(ye)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye)開展技(ji)(ji)術(shu)服務期(qi)間,與(yu)所(suo)在(zai)(zai)單(dan)位其他在(zai)(zai)崗人員(yuan)(yuan)享受同等(deng)參加專(zhuan)業(ye)(ye)(ye)(ye)(ye)技(ji)(ji)術(shu)職(zhi)(zhi)務評聘、崗位等(deng)級晉升和(he)社會保險等(deng)權利,促進科(ke)研(yan)人才在(zai)(zai)事(shi)(shi)業(ye)(ye)(ye)(ye)(ye)單(dan)位和(he)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)(ye)之間的(de)(de)合理雙(shuang)向流(liu)(liu)動。
五、進一步明確種業成果處置和收益分配比例
公益性科(ke)研院所(suo)和(he)高等(deng)院校(xiao)利用國家撥(bo)款發明的育(yu)種(zhong)(zhong)材料、新(xin)品種(zhong)(zhong)和(he)技術(shu)(shu)成(cheng)(cheng)果可以(yi)作(zuo)價到企業投資入(ru)股,也可以(yi)上(shang)市交易,嚴禁私(si)下違規交易;科(ke)研院所(suo)和(he)高等(deng)院校(xiao)的種(zhong)(zhong)業科(ke)研成(cheng)(cheng)果轉讓收(shou)入(ru)可按照60%—95%的比例獎勵(li)給完成(cheng)(cheng)人及(ji)其團(tuan)隊,允許國有種(zhong)(zhong)業企業對有貢獻的科(ke)技人員和(he)管(guan)理層采用股權激勵(li)(增(zeng)量(liang)持股或增(zeng)量(liang)獎股)、期權分(fen)配、技術(shu)(shu)入(ru)股等(deng)方式進(jin)行獎勵(li);完善育(yu)種(zhong)(zhong)科(ke)技項目管(guan)理辦法(fa),逐(zhu)步(bu)改變論文(wen)導向機(ji)制,并(bing)將商業化育(yu)種(zhong)(zhong)成(cheng)(cheng)果及(ji)推(tui)廣面積作(zuo)為職稱(cheng)評聘、科(ke)技獎項的重要(yao)依據。
六、建立健全公益性資源開放共享機制
利用(yong)國家種(zhong)業(ye)科技成(cheng)果產權(quan)交(jiao)(jiao)易平臺(tai),探(tan)索建(jian)(jian)立(li)浙江省種(zhong)業(ye)科技成(cheng)果交(jiao)(jiao)易平臺(tai)和(he)托管中(zhong)心(xin),制訂交(jiao)(jiao)易管理辦法,拓寬(kuan)種(zhong)業(ye)科技成(cheng)果向企業(ye)轉化的渠道。加快建(jian)(jian)立(li)種(zhong)業(ye)科技成(cheng)果管理數據庫,并(bing)有序向社會公開;加快完善種(zhong)質(zhi)資源(yuan)(yuan)保護管理體系(xi);財政資金支持建(jian)(jian)設(she)的科研基礎設(she)施、大型(xing)科研儀器和(he)專利基礎信息(xi)資源(yuan)(yuan)要逐(zhu)步向社會開放,充分發揮(hui)其(qi)公益性資源(yuan)(yuan)的作用(yong)。
七、加強組織領導和政策支持
加大對種子生產基地扶持力度,支持種業企業與制種大戶、農民合作社建立長期穩定的合作關系,種業企業的種子加工、晾曬等配套設施用地按照《浙江省國土資源廳浙江省農業廳關于進一步支持設施農業發展的通知》(浙土資〔2015〕9號)規定執行。探索開展種子保險,率先開展水稻制(zhi)繁(fan)種與種子(zi)質量政策性保險試點工(gong)作(zuo),切實(shi)降低(di)水(shui)稻制(zhi)繁(fan)種農戶和(he)種業企業生產經(jing)營風險,維護廣(guang)大(da)農民群眾的利益和(he)社會穩(wen)定。各(ge)地要(yao)進一步健(jian)全(quan)種業管理(li)體(ti)制(zhi),加強種業工(gong)作(zuo)力量,加大(da)財政支持力度,完善監(jian)管服務(wu)機制(zhi),嚴厲打(da)擊侵(qin)犯品種權(quan)和(he)制(zhi)售假劣種子(zi)等違(wei)法犯罪行(xing)為(wei),為(wei)種業發(fa)展提(ti)供(gong)良好環境。
