湖南省農業委員會關于貫徹實施《種子法》全面推進依法治種的通知
各市(shi)(shi)州農委、縣市(shi)(shi)區農業(ye)局,各有(you)關單位:
《中華人民共和國種子法(fa)》(以(yi)下(xia)簡稱《種(zhong)子法(fa)》)自(zi)2016年(nian)1月1日起施(shi)行,農(nong)(nong)業(ye)部(bu)印發(fa)了《關于貫(guan)徹(che)實(shi)施(shi)<種(zhong)子法(fa)>全面(mian)推進(jin)依(yi)法(fa)治種(zhong)的通(tong)知》(農(nong)(nong)種(zhong)發(fa)〔2016〕1號(hao)),對貫(guan)徹(che)實(shi)施(shi)新(xin)修訂的《種(zhong)子法(fa)》提出了明(ming)確(que)要(yao)求(qiu),為深入貫(guan)徹(che)落(luo)實(shi)《種(zhong)子法(fa)》新(xin)規定(ding)和農(nong)(nong)業(ye)部(bu)指示精神,全面(mian)推進(jin)依(yi)法(fa)治種(zhong),促進(jin)我省(sheng)農(nong)(nong)作(zuo)(zuo)物種(zhong)業(ye)發(fa)展(zhan),建設現代種(zhong)業(ye)強(qiang)省(sheng),現就有關工(gong)作(zuo)(zuo)通(tong)知如下(xia)。
一、培訓宣傳同推進,增強學習貫徹《種子法》的責任感
(一)切(qie)實(shi)深化思想認(ren)識。新修(xiu)(xiu)訂的(de)《種(zhong)(zhong)子法(fa)》是在總結過去(qu)15年實(shi)踐(jian)的(de)基(ji)(ji)礎上,結合現(xian)(xian)代(dai)農業(ye)(ye)發(fa)(fa)展需求和(he)種(zhong)(zhong)業(ye)(ye)發(fa)(fa)展現(xian)(xian)狀,并(bing)借鑒國(guo)(guo)際(ji)種(zhong)(zhong)業(ye)(ye)立法(fa)理(li)念,對我(wo)國(guo)(guo)種(zhong)(zhong)業(ye)(ye)基(ji)(ji)本法(fa)律(lv)制(zhi)(zhi)度的(de)全(quan)面修(xiu)(xiu)訂和(he)完(wan)善(shan)。此次(ci)修(xiu)(xiu)訂貫徹了(le)中央全(quan)面深化改革、依法(fa)治國(guo)(guo)戰略布(bu)局的(de)要(yao)求,契合了(le)發(fa)(fa)展現(xian)(xian)代(dai)種(zhong)(zhong)業(ye)(ye)的(de)部署,順應了(le)我(wo)國(guo)(guo)種(zhong)(zhong)業(ye)(ye)改革發(fa)(fa)展的(de)客觀要(yao)求,為加快(kuai)現(xian)(xian)代(dai)種(zhong)(zhong)業(ye)(ye)發(fa)(fa)展、建設(she)種(zhong)(zhong)業(ye)(ye)強(qiang)國(guo)(guo)奠定了(le)法(fa)律(lv)基(ji)(ji)礎,對于轉(zhuan)變農業(ye)(ye)發(fa)(fa)展方式、確(que)保國(guo)(guo)家(jia)糧食安(an)全(quan)具有重要(yao)意(yi)義。全(quan)省各級(ji)農業(ye)(ye)主管部門要(yao)深入學(xue)習(xi)領會,更新觀念,深化認(ren)識,把思想和(he)行動統一到《種(zhong)(zhong)子法(fa)》的(de)新要(yao)求上來,切(qie)實(shi)增(zeng)強(qiang)使命(ming)感(gan)和(he)責任感(gan),把各項(xiang)法(fa)定制(zhi)(zhi)度和(he)職責落到實(shi)處,全(quan)面推進依法(fa)治種(zhong)(zhong),促(cu)進我(wo)省種(zhong)(zhong)業(ye)(ye)更好更快(kuai)發(fa)(fa)展,建設(she)現(xian)(xian)代(dai)種(zhong)(zhong)業(ye)(ye)強(qiang)省。
(二)準確把(ba)握精神實質。《種(zhong)(zhong)(zhong)(zhong)(zhong)子(zi)法(fa)》以發展現代種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)、保障糧(liang)食安(an)(an)全(quan)(quan)、保護(hu)農民利(li)益(yi)為(wei)宗旨(zhi),堅持(chi)市(shi)場(chang)化(hua)(hua)改革(ge)方(fang)向,按照鼓勵創新、簡(jian)政放權(quan)(quan)、放管結合原則,對種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)科研育(yu)種(zhong)(zhong)(zhong)(zhong)(zhong)、生產經營、監督管理(li)等(deng)制度進行(xing)了(le)全(quan)(quan)面(mian)改革(ge)。學(xue)習貫(guan)徹《種(zhong)(zhong)(zhong)(zhong)(zhong)子(zi)法(fa)》,要堅持(chi)深(shen)化(hua)(hua)種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)體制改革(ge),推進種(zhong)(zhong)(zhong)(zhong)(zhong)子(zi)管理(li)簡(jian)政放權(quan)(quan),激(ji)發市(shi)場(chang)主(zhu)(zhu)體活力;要堅持(chi)強化(hua)(hua)企(qi)業(ye)(ye)創新主(zhu)(zhu)體地位,推進科研改革(ge)和自主(zhu)(zhu)創新,保護(hu)創新者合法(fa)權(quan)(quan)益(yi);要堅持(chi)保護(hu)農民利(li)益(yi),健全(quan)(quan)企(qi)業(ye)(ye)行(xing)為(wei)規(gui)范,加強事中事后監管,強化(hua)(hua)主(zhu)(zhu)體責任(ren)落(luo)實,加大(da)違法(fa)行(xing)為(wei)處罰力度和賠償責任(ren);要堅持(chi)保障糧(liang)食安(an)(an)全(quan)(quan),完(wan)善種(zhong)(zhong)(zhong)(zhong)(zhong)子(zi)質量監督管理(li),健全(quan)(quan)種(zhong)(zhong)(zhong)(zhong)(zhong)子(zi)儲備(bei)體系(xi),規(gui)范種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)對外(wai)交流合作,強化(hua)(hua)安(an)(an)全(quan)(quan)審查,確保種(zhong)(zhong)(zhong)(zhong)(zhong)業(ye)(ye)安(an)(an)全(quan)(quan)。
(三)深入(ru)開展(zhan)(zhan)學習培(pei)(pei)訓(xun)。全省各級農(nong)(nong)業(ye)(ye)主(zhu)管(guan)部門(men)要認真(zhen)制定學習培(pei)(pei)訓(xun)計劃,結合各地實(shi)際開展(zhan)(zhan)形式多(duo)樣的(de)學習培(pei)(pei)訓(xun)活動,盡(jin)快幫助種子(zi)生產者、經營者和(he)管(guan)理者準確掌握《種子(zi)法(fa)(fa)(fa)》的(de)各項新要求。省級將(jiang)通過專(zhuan)題培(pei)(pei)訓(xun)班、電視電話會(hui)議等方式,分階段(duan)多(duo)層(ceng)次對各市州(zhou)農(nong)(nong)委、縣(xian)市區農(nong)(nong)業(ye)(ye)局的(de)相(xiang)關人(ren)員進(jin)行系統培(pei)(pei)訓(xun),深入(ru)解讀(du)《種子(zi)法(fa)(fa)(fa)》及配套實(shi)施辦法(fa)(fa)(fa),培(pei)(pei)養一批宣貫《種子(zi)法(fa)(fa)(fa)》的(de)骨干師資力量。各市州(zhou)、縣(xian)市區農(nong)(nong)業(ye)(ye)主(zhu)管(guan)部門(men)要準確把握立法(fa)(fa)(fa)精(jing)神和(he)原(yuan)則,深刻理解《種子(zi)法(fa)(fa)(fa)》的(de)精(jing)神實(shi)質(zhi),面向科研單位、企(qi)業(ye)(ye)、經銷門(men)店、種植大戶、專(zhuan)業(ye)(ye)合作社等開展(zhan)(zhan)專(zhuan)題學習培(pei)(pei)訓(xun),夯實(shi)全行業(ye)(ye)懂(dong)法(fa)(fa)(fa)守法(fa)(fa)(fa)、依(yi)法(fa)(fa)(fa)從(cong)業(ye)(ye)的(de)基礎。
(四)廣泛(fan)進行(xing)普法宣(xuan)傳(chuan)。全省(sheng)各級農(nong)業(ye)(ye)主管部(bu)(bu)門、相(xiang)關單位要(yao)多形式(shi)、多渠道(dao)廣泛(fan)開(kai)展《種子(zi)(zi)法》宣(xuan)傳(chuan),在(zai)全省(sheng)迅速掀起宣(xuan)傳(chuan)《種子(zi)(zi)法》的(de)熱潮(chao),營造學法、知法、懂法和用法的(de)良好社會氛圍。各地(di)要(yao)利用廣播電視、網絡報(bao)刊(kan)等媒體和發放掛(gua)圖、明白紙等方式(shi),把(ba)法律(lv)(lv)新規普及到基(ji)層網點和鄉村農(nong)戶(hu),讓廣大生產經(jing)營者自(zi)覺(jue)遵法守法、廣大農(nong)民學會運用法律(lv)(lv)維護(hu)權益,為(wei)法律(lv)(lv)實施奠定群眾基(ji)礎。各級農(nong)業(ye)(ye)主管部(bu)(bu)門要(yao)采取送法下鄉、開(kai)辟宣(xuan)傳(chuan)專欄、發放宣(xuan)傳(chuan)資(zi)料等方式(shi),拓展輿論宣(xuan)傳(chuan)渠道(dao),提(ti)高全社會對《種子(zi)(zi)法》的(de)關注度。省(sheng)、市、縣三(san)級農(nong)業(ye)(ye)主管部(bu)(bu)門要(yao)在(zai)3.15國際消費者權益日同步開(kai)展《種子(zi)(zi)法》的(de)宣(xuan)傳(chuan)活動(dong),為(wei)基(ji)層普及法律(lv)(lv)新規,為(wei)群眾答疑解惑。
二、清理規范兩手抓,構建適應現代種業發展的制度體系
(五)清理修(xiu)訂地方規章(zhang)。全(quan)省(sheng)(sheng)各級農(nong)業主管部門(men)要立(li)足本地農(nong)業發展(zhan)實際和(he)(he)種(zhong)(zhong)業現狀,認真梳理種(zhong)(zhong)子監(jian)管執(zhi)法(fa)方面(mian)的(de)規章(zhang)制度,不(bu)符(fu)合(he)(he)《種(zhong)(zhong)子法(fa)》精神(shen)的(de)要及(ji)時清理廢除,不(bu)適應新(xin)要求的(de)要抓緊修(xiu)訂完善(shan)。各地要積極配合(he)(he)開展(zhan)貫(guan)徹實施《種(zhong)(zhong)子法(fa)》調研(yan),在支持種(zhong)(zhong)業創(chuang)新(xin)、健全(quan)管理體(ti)系、執(zhi)法(fa)能(neng)力(li)建(jian)設(she)等方面(mian),研(yan)究(jiu)提(ti)(ti)(ti)出配套政策和(he)(he)保障措施,為加(jia)強依(yi)法(fa)治種(zhong)(zhong)能(neng)力(li)建(jian)設(she)提(ti)(ti)(ti)供支撐(cheng)。省(sheng)(sheng)級將(jiang)加(jia)強與省(sheng)(sheng)人(ren)大、省(sheng)(sheng)政府及(ji)相關(guan)職能(neng)部門(men)溝通(tong),盡快(kuai)啟(qi)動(dong)《湖南(nan)省(sheng)(sheng)實施〈中華人(ren)民(min)共和(he)(he)國種(zhong)(zhong)子法(fa)〉辦(ban)法(fa)》的(de)修(xiu)訂工作,為全(quan)省(sheng)(sheng)貫(guan)徹實施《種(zhong)(zhong)子法(fa)》提(ti)(ti)(ti)供行(xing)動(dong)指(zhi)南(nan)。
(六(liu))健全管(guan)(guan)理制(zhi)(zhi)度規范(fan)。按(an)照簡政(zheng)放權、放管(guan)(guan)結合(he)、優(you)化服務(wu)要求,合(he)并種子(zi)(zi)生產經(jing)(jing)營(ying)許可(ke)制(zhi)(zhi)度,取消(xiao)注冊(ce)資本(ben)、先證后照等準入前置(zhi)條(tiao)件,簡化許可(ke)審批(pi)程序(xu),方便申請者(zhe);取消(xiao)種子(zi)(zi)檢(jian)驗(yan)員(yuan)資格考核;針(zhen)對企(qi)業設立(li)分支機(ji)(ji)構、委托生產或代(dai)銷、專門經(jing)(jing)營(ying)不再分裝(zhuang)的(de)包裝(zhuang)種子(zi)(zi),建(jian)立(li)縣級備案制(zhi)(zhi)度,構建(jian)省、市、縣三級種業信息互(hu)通平臺,開展在線(xian)申請、許可(ke)審批(pi)和(he)網(wang)上備案。推進企(qi)業行(xing)為規范(fan)化制(zhi)(zhi)度建(jian)設,健全種子(zi)(zi)生產經(jing)(jing)營(ying)檔(dang)案制(zhi)(zhi)度、標簽真實性(xing)制(zhi)(zhi)度和(he)產地(di)檢(jian)疫制(zhi)(zhi)度,建(jian)立(li)企(qi)業信用信息公(gong)開機(ji)(ji)制(zhi)(zhi)。
(七)建立創新(xin)(xin)(xin)保護制(zhi)度(du)(du)。堅持(chi)創新(xin)(xin)(xin)驅動發展(zhan)(zhan)理念,加大(da)種(zhong)(zhong)業創新(xin)(xin)(xin)財(cai)政投(tou)入(ru)和(he)(he)政策扶持(chi)力度(du)(du),支持(chi)我省種(zhong)(zhong)業科(ke)研單(dan)位開展(zhan)(zhan)基礎性、公益性研究,鼓勵種(zhong)(zhong)子企業以商業化育(yu)種(zhong)(zhong)為(wei)核心進行自(zi)主(zhu)創新(xin)(xin)(xin),推(tui)進鼓勵創新(xin)(xin)(xin)政策的制(zhi)度(du)(du)化建設(she)。完(wan)善種(zhong)(zhong)質(zhi)資源保護與利用(yong)制(zhi)度(du)(du),促進種(zhong)(zhong)質(zhi)創新(xin)(xin)(xin)和(he)(he)依(yi)法開放利用(yong)。實施嚴格的植物新(xin)(xin)(xin)品(pin)種(zhong)(zhong)保護制(zhi)度(du)(du),優(you)化品(pin)種(zhong)(zhong)權申請(qing)、受理、審查(cha)和(he)(he)授權流程(cheng),健全品(pin)種(zhong)(zhong)權信息公開機制(zhi),保護品(pin)種(zhong)(zhong)權人合法權益。建立以財(cai)政支持(chi)為(wei)主(zhu)形(xing)成(cheng)的種(zhong)(zhong)業科(ke)研成(cheng)果依(yi)法公開轉讓制(zhi)度(du)(du),禁止私(si)自(zi)交易(yi)。
(八)完善品(pin)(pin)種(zhong)管(guan)理(li)(li)制(zhi)(zhi)度(du)。引導企業以(yi)市(shi)場(chang)需求導向開(kai)(kai)展商業化(hua)育種(zhong),推(tui)動過去單純強調(diao)高產(chan)(chan)向實現(xian)高產(chan)(chan)、優(you)質(zhi)(zhi)、高抗(kang)、生態、安全等多目標協(xie)(xie)調(diao)轉(zhuan)變,培(pei)育推(tui)廣一(yi)批(pi)優(you)質(zhi)(zhi)、高產(chan)(chan)、多抗(kang)、廣適和適宜機械化(hua)的(de)(de)優(you)良新品(pin)(pin)種(zhong)。修正主(zhu)要農(nong)作物(wu)(wu)品(pin)(pin)種(zhong)審定制(zhi)(zhi)度(du),建(jian)立以(yi)種(zhong)性安全為(wei)重點(dian)的(de)(de)品(pin)(pin)種(zhong)測試評價(jia)體系(xi)。拓寬品(pin)(pin)種(zhong)試驗渠道,支持(chi)育繁推(tui)一(yi)體化(hua)企業開(kai)(kai)展自有(you)品(pin)(pin)種(zhong)試驗,鼓勵(li)種(zhong)子(zi)企業聯(lian)合體自主(zhu)開(kai)(kai)展品(pin)(pin)種(zhong)試驗試點(dian),并納入省級品(pin)(pin)種(zhong)試驗統一(yi)管(guan)理(li)(li)。建(jian)立同一(yi)生態區省間引種(zhong)備案制(zhi)(zhi)度(du),明確(que)引種(zhong)者責任(ren)。堅持(chi)以(yi)市(shi)場(chang)需求為(wei)導向,按(an)照全國(guo)統一(yi)、部省協(xie)(xie)同的(de)(de)要求,建(jian)立非(fei)主(zhu)要農(nong)作物(wu)(wu)品(pin)(pin)種(zhong)登記制(zhi)(zhi)度(du)。
(九(jiu))強化(hua)產業(ye)監管制(zhi)度(du)。完善種(zhong)(zhong)(zhong)(zhong)子(zi)質(zhi)量(liang)監督管理(li)制(zhi)度(du),健全(quan)(quan)檢測技(ji)術標(biao)(biao)準,推行種(zhong)(zhong)(zhong)(zhong)子(zi)自愿認證制(zhi)度(du),強化(hua)質(zhi)量(liang)安(an)(an)全(quan)(quan)主體責任落實,結合標(biao)(biao)簽(qian)標(biao)(biao)識信息(xi)實現(xian)可(ke)追(zhui)溯,保(bao)障種(zhong)(zhong)(zhong)(zhong)子(zi)質(zhi)量(liang)安(an)(an)全(quan)(quan)。以(yi)救(jiu)災調(diao)用和余缺調(diao)劑為目標(biao)(biao),優化(hua)儲備(bei)品種(zhong)(zhong)(zhong)(zhong)結構,創新儲備(bei)工作機制(zhi),完善省級(ji)救(jiu)災備(bei)荒(huang)種(zhong)(zhong)(zhong)(zhong)子(zi)儲備(bei)制(zhi)度(du)。健全(quan)(quan)種(zhong)(zhong)(zhong)(zhong)子(zi)進(jin)出口管理(li)制(zhi)度(du),引進(jin)國外優良品種(zhong)(zhong)(zhong)(zhong)資源,加快對外合作交流,實施(shi)我省種(zhong)(zhong)(zhong)(zhong)業(ye)“走出去”發展戰略,支持優勢種(zhong)(zhong)(zhong)(zhong)子(zi)企業(ye)大力(li)開拓國際市場。按照平等、互利(li)、共贏原則(ze),建立種(zhong)(zhong)(zhong)(zhong)業(ye)外商投資和合作研發安(an)(an)全(quan)(quan)審(shen)查機制(zhi),保(bao)護(hu)民族種(zhong)(zhong)(zhong)(zhong)業(ye)安(an)(an)全(quan)(quan)。
三、監管服務相結合,切實履行《種子法》賦予的各項職責
(十)全(quan)面落實(shi)簡政放權。全(quan)省各(ge)級農業(ye)主(zhu)管(guan)部門要在保障國家糧食(shi)安(an)全(quan)和保護農民利益的前提下,最大限度簡化(hua)政府職能,充分發揮市(shi)場作用,有(you)效激發市(shi)場活力。減(jian)少審定(ding)農作物(wu)數量;簡化(hua)引(yin)種(zhong)程序(xu),農作物(wu)引(yin)種(zhong)實(shi)行(xing)備案管(guan)理;種(zhong)子生產與經(jing)營“兩證”實(shi)行(xing)合(he)(he)并(bing)管(guan)理,取消(xiao)注冊資本、先證后照(zhao)等準入前置條件,簡化(hua)種(zhong)子行(xing)政許可程序(xu);取消(xiao)品(pin)種(zhong)審定(ding)預備試驗(yan)環節,生產試驗(yan)與第(di)二個周期區域試驗(yan)同步進(jin)行(xing),縮(suo)短品(pin)種(zhong)試驗(yan)審定(ding)周期,加速種(zhong)業(ye)科研育種(zhong)成果轉化(hua);為育繁(fan)推一體化(hua)企(qi)業(ye)開(kai)(kai)辟(pi)品(pin)種(zhong)審定(ding)綠色通道,引(yin)導企(qi)業(ye)聯合(he)(he)體自(zi)主(zhu)開(kai)(kai)展品(pin)種(zhong)試驗(yan),充分賦予企(qi)業(ye)自(zi)主(zhu)權。
(十一(yi))依法(fa)履行監(jian)管(guan)(guan)(guan)(guan)職(zhi)責(ze)(ze)。全(quan)省(sheng)各(ge)(ge)級(ji)(ji)農業主管(guan)(guan)(guan)(guan)部(bu)門要(yao)按照《種(zhong)子(zi)法(fa)》賦(fu)予(yu)的(de)(de)職(zhi)責(ze)(ze)要(yao)求,明確各(ge)(ge)級(ji)(ji)種(zhong)子(zi)管(guan)(guan)(guan)(guan)理(li)(li)機構(gou)在(zai)種(zhong)質(zhi)資(zi)源(yuan)管(guan)(guan)(guan)(guan)理(li)(li)、品種(zhong)審定與(yu)登記、生產經(jing)營(ying)(ying)許(xu)可與(yu)備案(an)、質(zhi)量監(jian)督與(yu)認證等方面(mian)的(de)(de)管(guan)(guan)(guan)(guan)理(li)(li)職(zhi)責(ze)(ze),推動(dong)由事前許(xu)可向事中事后監(jian)管(guan)(guan)(guan)(guan)轉(zhuan)移,強化過程監(jian)管(guan)(guan)(guan)(guan)。建(jian)立許(xu)可與(yu)備案(an)銜(xian)接、檔案(an)管(guan)(guan)(guan)(guan)理(li)(li)、企業信用管(guan)(guan)(guan)(guan)理(li)(li)等制度,促使種(zhong)子(zi)企業誠信生產經(jing)營(ying)(ying),保證種(zhong)子(zi)來源(yuan)可追溯。各(ge)(ge)級(ji)(ji)種(zhong)子(zi)管(guan)(guan)(guan)(guan)理(li)(li)部(bu)門要(yao)將種(zhong)子(zi)安全(quan)監(jian)管(guan)(guan)(guan)(guan)重心前移至制種(zhong)基地,從源(yuan)頭上(shang)預(yu)防制售假(jia)劣種(zhong)子(zi)等違法(fa)行為。縣級(ji)(ji)要(yao)依法(fa)開展(zhan)種(zhong)子(zi)生產經(jing)營(ying)(ying)許(xu)可及備案(an)管(guan)(guan)(guan)(guan)理(li)(li)。
(十二(er))加(jia)大市(shi)場(chang)監管(guan)(guan)力度。全省各級(ji)農業(ye)主管(guan)(guan)部門(men)要(yao)(yao)采取有效措(cuo)施(shi)加(jia)強市(shi)場(chang)監管(guan)(guan)和(he)執法(fa)監督(du),依法(fa)懲(cheng)處侵害農民利益和(he)企業(ye)合(he)法(fa)權益的(de)違(wei)(wei)法(fa)行(xing)(xing)為(wei)(wei)(wei),將違(wei)(wei)法(fa)紀錄納(na)入社會征(zheng)信體系。強化事(shi)中事(shi)后監管(guan)(guan),抓住重點(dian)作(zuo)物、重點(dian)區(qu)域,按照“雙(shuang)隨機”要(yao)(yao)求開展企業(ye)督(du)查、市(shi)場(chang)檢查和(he)基地巡查,強化種子標(biao)簽真實性監管(guan)(guan),依法(fa)行(xing)(xing)使(shi)行(xing)(xing)政(zheng)強制權。以品種真實性為(wei)(wei)(wei)核心,利用標(biao)準樣品和(he)快速(su)檢測方法(fa),打(da)擊假冒侵權等違(wei)(wei)法(fa)行(xing)(xing)為(wei)(wei)(wei)。各市(shi)州農業(ye)主管(guan)(guan)部門(men)要(yao)(yao)加(jia)強對轄區(qu)內(nei)縣(xian)市(shi)區(qu)依法(fa)監管(guan)(guan)情況的(de)督(du)導,要(yao)(yao)強化行(xing)(xing)政(zheng)問責(ze),堅(jian)決糾正(zheng)不作(zuo)為(wei)(wei)(wei)、亂作(zuo)為(wei)(wei)(wei)、慢作(zuo)為(wei)(wei)(wei)等行(xing)(xing)為(wei)(wei)(wei)。
(十三)強化種(zhong)子行(xing)政(zheng)執法(fa)。全省各級農(nong)業(ye)主管(guan)部門要建立上(shang)下聯動、地(di)區聯動、檢打聯動機(ji)制,將加(jia)強種(zhong)子執法(fa)由部門行(xing)為(wei)上(shang)升為(wei)政(zheng)府行(xing)為(wei),加(jia)大(da)涉種(zhong)案件查處(chu)力(li)度,依法(fa)嚴懲制假(jia)售假(jia)、破壞(huai)種(zhong)質資源和侵犯(fan)品(pin)種(zhong)權等違法(fa)行(xing)為(wei),涉嫌犯(fan)罪的及時移交司(si)法(fa)機(ji)關,杜絕以罰代管(guan)、以罰代刑(xing)。
(十四)推進科研體制改革。全省各級農業主管部門要把推進種業改革做為重點工作來抓,以改革增強種業創新發展活力。堅持基礎性科研與商業化育種合理分工,強化企業創新主體地位,鼓勵企業利用公益性成果培育新品種。推進種業科研成果權益化改革,探索建立成果權益分享、轉移轉化和科研人員分類管理機制,促進科研人才向企業有序流動。推進種業科企合作,建立產學研結合的研發創新體系,提升種業育繁推一體化水平。加快建設我省水稻分子育種(zhong)(zhong)平臺,推動(dong)科(ke)研育種(zhong)(zhong)由傳統方式向生(sheng)物分子水平轉變。
(十五)推動落實種業政策。各級農業主管部門要加強與財政、發改、科技、金融(rong)保險等部門(men)溝通,強(qiang)化工作協調(diao)機制(zhi)(zhi)(zhi),把法定政策措(cuo)施落實(shi)到位(wei)。以(yi)鼓(gu)勵(li)品(pin)種(zhong)(zhong)(zhong)(zhong)創(chuang)新為目標,增加(jia)(jia)財(cai)政投入,支持種(zhong)(zhong)(zhong)(zhong)質資源保護(hu)和品(pin)種(zhong)(zhong)(zhong)(zhong)選育(yu)(yu)、試(shi)驗(yan)及(ji)示(shi)范推廣,研究建(jian)立按推廣面積的品(pin)種(zhong)(zhong)(zhong)(zhong)后補(bu)助機制(zhi)(zhi)(zhi)。以(yi)穩定基(ji)地、提升產(chan)能為目標,將優勢制(zhi)(zhi)(zhi)種(zhong)(zhong)(zhong)(zhong)基(ji)地劃入基(ji)本農田永久保護(hu),落實(shi)制(zhi)(zhi)(zhi)種(zhong)(zhong)(zhong)(zhong)大(da)縣獎勵(li)、制(zhi)(zhi)(zhi)種(zhong)(zhong)(zhong)(zhong)保險和農機補(bu)貼政策。加(jia)(jia)快我省(sheng)南繁科研育(yu)(yu)種(zhong)(zhong)(zhong)(zhong)園(yuan)區(qu)、制(zhi)(zhi)(zhi)種(zhong)(zhong)(zhong)(zhong)產(chan)業園(yuan)區(qu)建(jian)設,高標準規劃建(jian)設我省(sheng)現代化科研育(yu)(yu)種(zhong)(zhong)(zhong)(zhong)基(ji)地、良種(zhong)(zhong)(zhong)(zhong)繁育(yu)(yu)基(ji)地。
(十六)提升種(zhong)業(ye)(ye)(ye)監(jian)管服務。全(quan)(quan)省各(ge)級(ji)農(nong)業(ye)(ye)(ye)主管部(bu)門(men)要強化種(zhong)業(ye)(ye)(ye)監(jian)管服務職能,按(an)照調結構、轉方式的總要求,引(yin)導品(pin)(pin)種(zhong)研發(fa)、生產、經營、監(jian)管等(deng)方式的根本(ben)轉變,推動我省種(zhong)業(ye)(ye)(ye)向高(gao)(gao)產、優質(zhi)、高(gao)(gao)效(xiao)、生態、安全(quan)(quan)并重發(fa)展(zhan)。各(ge)地要加(jia)強技(ji)術(shu)支撐(cheng)體(ti)系(xi)建設,切實做(zuo)好(hao)品(pin)(pin)種(zhong)試驗、新品(pin)(pin)種(zhong)展(zhan)示示范等(deng)工作,加(jia)快優良新品(pin)(pin)種(zhong)的推廣應用(yong)。縣級(ji)農(nong)業(ye)(ye)(ye)主管部(bu)門(men)要將品(pin)(pin)種(zhong)安全(quan)(quan)跟(gen)蹤評價作為強化種(zhong)業(ye)(ye)(ye)監(jian)管服務的一項核心工作來抓,有效(xiao)規避農(nong)業(ye)(ye)(ye)生產風險和種(zhong)業(ye)(ye)(ye)安全(quan)(quan)風險,服務種(zhong)子企業(ye)(ye)(ye)做(zuo)大做(zuo)強。
四、硬件軟件同突破,進一步提升依法治種能力和管理水平
(十(shi)七)理(li)順種(zhong)(zhong)子(zi)(zi)管理(li)職能。全省(sheng)各級農業主管部門要(yao)依法(fa)厘清和強(qiang)化種(zhong)(zhong)子(zi)(zi)管理(li)職能,加快由管種(zhong)(zhong)子(zi)(zi)向管種(zhong)(zhong)業轉變,加強(qiang)種(zhong)(zhong)質(zhi)資源收集、新(xin)品種(zhong)(zhong)保護、品種(zhong)(zhong)審定與(yu)登記、種(zhong)(zhong)子(zi)(zi)生產經營許可(ke)與(yu)備案(an)、質(zhi)量監(jian)督等管理(li)工作(zuo),堅持糧食經濟作(zuo)物(wu)并重、種(zhong)(zhong)子(zi)(zi)種(zhong)(zhong)苗并重、管理(li)服務結合(he),構建理(li)念先進、職能明(ming)確、制度健全的種(zhong)(zhong)業監(jian)管服務體系。
(十(shi)八)加強管(guan)(guan)理(li)能(neng)(neng)力(li)建(jian)設。全省各(ge)(ge)級(ji)(ji)農業(ye)(ye)主管(guan)(guan)部門(men)要強化種(zhong)(zhong)(zhong)子管(guan)(guan)理(li)體系建(jian)設,健全種(zhong)(zhong)(zhong)子管(guan)(guan)理(li)機(ji)構(gou),充實種(zhong)(zhong)(zhong)子管(guan)(guan)理(li)人員(yuan)隊伍(wu),改善種(zhong)(zhong)(zhong)子管(guan)(guan)理(li)手段,提(ti)升種(zhong)(zhong)(zhong)業(ye)(ye)監管(guan)(guan)服務能(neng)(neng)力(li)。各(ge)(ge)縣(xian)市區農業(ye)(ye)主管(guan)(guan)部門(men)是貫(guan)徹實施《種(zhong)(zhong)(zhong)子法》的基礎(chu)力(li)量(liang),要充實縣(xian)級(ji)(ji)種(zhong)(zhong)(zhong)子管(guan)(guan)理(li)執法隊伍(wu),加強種(zhong)(zhong)(zhong)子生(sheng)產(chan)經營許可、備案管(guan)(guan)理(li)及假(jia)冒侵(qin)權(quan)案件查處等工作(zuo)。強化管(guan)(guan)理(li)能(neng)(neng)力(li)建(jian)設,改善種(zhong)(zhong)(zhong)質資源保護和品種(zhong)(zhong)(zhong)試驗、展示示范、種(zhong)(zhong)(zhong)子檢測、執法裝備等基礎(chu)設施條件,建(jian)立健全技術規范標準和管(guan)(guan)理(li)制度,保障(zhang)種(zhong)(zhong)(zhong)業(ye)(ye)監管(guan)(guan)執法工作(zuo)經費,提(ti)高技術支撐和服務能(neng)(neng)力(li)。
(十九)完善(shan)種(zhong)(zhong)(zhong)業信(xin)(xin)息(xi)管(guan)理。建立省(sheng)、市、縣三(san)級(ji)互通種(zhong)(zhong)(zhong)業數(shu)(shu)據(ju)信(xin)(xin)息(xi)平臺,匯集品(pin)種(zhong)(zhong)(zhong)保護、審定、登記和種(zhong)(zhong)(zhong)子生產(chan)經營許可(ke)及備案、標(biao)簽等信(xin)(xin)息(xi),構建從(cong)品(pin)種(zhong)(zhong)(zhong)選育到種(zhong)(zhong)(zhong)子零售的(de)數(shu)(shu)據(ju)鏈,用信(xin)(xin)息(xi)化貫穿種(zhong)(zhong)(zhong)業監管(guan)全過程(cheng),提高管(guan)理效能。加強種(zhong)(zhong)(zhong)業信(xin)(xin)息(xi)采集分析(xi),做好(hao)與國家信(xin)(xin)息(xi)平臺對接和數(shu)(shu)據(ju)共享(xiang),實(shi)現(xian)可(ke)查詢可(ke)追溯。實(shi)施品(pin)種(zhong)(zhong)(zhong)身份(fen)標(biao)識和種(zhong)(zhong)(zhong)子質量認證,為(wei)科學公正(zheng)執法提供信(xin)(xin)息(xi)支持(chi)。鼓勵利用互聯網(wang)建立面向農戶的(de)品(pin)種(zhong)(zhong)(zhong)推廣大數(shu)(shu)據(ju),形(xing)成線(xian)上(shang)線(xian)下相結合的(de)新(xin)品(pin)種(zhong)(zhong)(zhong)展示示范體系,為(wei)農民選購(gou)良(liang)(liang)種(zhong)(zhong)(zhong)、企業推廣良(liang)(liang)種(zhong)(zhong)(zhong)提供信(xin)(xin)息(xi)服(fu)務。
(二十(shi))切實(shi)加(jia)強統籌協(xie)調(diao)。全(quan)省各級農業(ye)主管部(bu)門要(yao)把貫徹(che)實(shi)施《種子(zi)法(fa)(fa)》擺在重要(yao)位置(zhi),切實(shi)加(jia)強組織領導(dao),強化部(bu)門協(xie)作,共同(tong)抓好《種子(zi)法(fa)(fa)》的貫徹(che)實(shi)施。對(dui)新(xin)增的法(fa)(fa)定職(zhi)責和管理職(zhi)能等事項,要(yao)加(jia)強與編制、人事、發改、財政(zheng)(zheng)等部(bu)門溝通協(xie)調(diao),配套(tao)相應(ying)保(bao)障措施。充分發揮種子(zi)行業(ye)協(xie)會在宣傳法(fa)(fa)規政(zheng)(zheng)策、強化行業(ye)自律、維護合(he)法(fa)(fa)權益、推動誠信建設、參與社(she)會監督、提(ti)供咨詢服務等方面的作用。
(二十一)深入開展(zhan)督(du)導檢查。全省(sheng)各級農業主管(guan)部門(men)要加強(qiang)貫徹實(shi)施(shi)《種(zhong)(zhong)子(zi)法(fa)(fa)》進展(zhan)的調(diao)研,及(ji)時(shi)反(fan)映實(shi)施(shi)中出現的新(xin)情(qing)(qing)況新(xin)問(wen)題,制定應對預案和解決措施(shi),保障法(fa)(fa)律順利(li)實(shi)施(shi)、有(you)序(xu)銜(xian)接。市(shi)州農業主管(guan)部門(men)要加強(qiang)轄區內(nei)各縣市(shi)區《種(zhong)(zhong)子(zi)法(fa)(fa)》實(shi)施(shi)情(qing)(qing)況的檢查,于2016年6月15日前將(jiang)貫徹實(shi)施(shi)情(qing)(qing)況報送(song)我(wo)(wo)委(wei)種(zhong)(zhong)子(zi)管(guan)理處(chu)和法(fa)(fa)規處(chu)。我(wo)(wo)委(wei)將(jiang)組(zu)織開展(zhan)全省(sheng)貫徹實(shi)施(shi)情(qing)(qing)況督(du)查,共同營(ying)造有(you)法(fa)(fa)必(bi)依、執法(fa)(fa)必(bi)嚴的良(liang)好局面,依法(fa)(fa)保障我(wo)(wo)省(sheng)現代(dai)種(zhong)(zhong)業持續、健康、快速發(fa)展(zhan)。
